Terms of Service

1. Eligibility

You must be at least 16 years old to use the Service. By using it you confirm that you have the legal capacity to enter into these Terms.

2. Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information when signing up and to keep it up to date. You must notify us promptly at folowupTeam@Outlook.com if you suspect any unauthorised use of your account.

3. The Service

folowup helps you manage professional contacts and generate outreach drafts using third-party AI models. The Service is provided on an "as is" basis. We may add, modify, or remove features at any time, and we may apply fair-use limits to features such as drafting, editing, and research.

4. Acceptable use

You agree not to:

• use the Service to send spam, harass, defraud, or impersonate any person;
• upload unlawful, defamatory, infringing, or harmful content;
• attempt to reverse-engineer, decompile, or interfere with the Service;
• use automated means to scrape or abuse the Service;
• use the Service to violate applicable laws, including data protection and anti-spam laws (such as the UK GDPR and PECR).

You are solely responsible for any messages you send through external channels (such as email or LinkedIn) using drafts generated by the Service.

5. Your content

You retain all rights in the contacts, notes, and content you add to the Service ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free licence to process Your Content solely to provide and improve the Service, including by passing it to our AI sub-processor for generation. We do not claim ownership of Your Content and we do not sell it.

6. AI outputs

Drafts, edits, and research summaries produced by the Service are generated by automated systems. They may contain inaccuracies, omissions, or material that could be misleading or inappropriate in context. You are responsible for reviewing all outputs before sending or relying on them. We make no warranty that AI outputs are accurate, complete, or fit for any particular purpose.

7. Fees and plans

The Service currently offers a free tier with usage limits. Paid plans may be introduced in future and will be offered on terms presented at the point of purchase. We will give you reasonable notice before any change to fees that affects your account.

8. Intellectual property

The Service, including its software, design, and trademarks, is owned by us or our licensors. Nothing in these Terms grants you any right in our intellectual property except as required to use the Service in accordance with these Terms.

9. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. On termination we will delete or anonymise your personal data in line with our Privacy Policy.

10. Disclaimers and liability

To the maximum extent permitted by law, we exclude all implied warranties and conditions. The Service is provided "as is" and we do not guarantee that it will be error-free or uninterrupted.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation. Subject to that, our total aggregate liability to you arising out of or in connection with the Service is limited to the greater of (a) the fees you have paid us in the 12 months immediately preceding the event giving rise to the liability, or (b) £100.

We are not liable for indirect, incidental, consequential, or special losses, or for loss of profits, business, opportunities, goodwill, or data.

11. Indemnity

You agree to indemnify us against any third-party claims arising from your breach of these Terms, your misuse of the Service, or your unlawful conduct.

12. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will give you reasonable advance notice by email or in-app message. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales. You and we agree to the exclusive jurisdiction of the courts of England and Wales for any dispute arising from or in connection with these Terms, except that we may bring proceedings in any jurisdiction where you reside to enforce our rights.
